PUBLIC NOTICE

NOTICE IS HEREBY GIVEN that the Charlestown Township Zoning Hearing Board will hear on February 28, 2024, at 7:30 p.m., at 11 General Warren Boulevard, Suite 1, Charlestown Township, Pennsylvania, Floyd E. Hertzfeld’s appeal of a Zoning Violation/Enforcement Notice issued September 18, 2023, by Charlestown Township’s Engineer/Zoning officer, Daniel T. Wright, P.E., pursuant to §616.1 of the Pennsylvania Municipalities Planning Code and Charlestown Township Zoning Ordinance, §27-2101 wherein Mr. Wright cites Floyd E. Hertzfeld, the owner of 11.3 acres and improvements thereon, located at 1133 Valley Hill Road (tax parcel 35-07-0014), situated in a FR, Farm Residential district, for the illegal use of said property for commercial purposes, namely, the maintenance thereon of many portable toilets, at any given time, septic testing equipment, grease traps, and related sewage disposal equipment used by Ace Disposal Services, contrary to §27-402 of the Ordinance. As Appellant, Mr. Hertzfeld submits that the Notice of Violation and Enforcement is barred by equitable estoppel; vested rights; and/or variance by estoppel. Alternatively, as Applicant, Mr. Hertzfeld, requests the Zoning Hearing Board grant a use variance from §27-402.
