The Major Differences Between the 4-7-08 Provisions (the original enactment date for the TND Ordinance) and the 5-7-10 Edits, are summarized under the ten (10) items listed below. The major differences are due to in large part to input from the Design Review Committee (DRC), the Planning Commission, the Township Solicitor, and the Township Engineer, in response to items discovered during the Plan preparation for the Spring Oak and Tyler Griffin TNDs.
1. | Exhibit B: The Manual of Written & Graphic Design Guidelines Revisions have been made regarding: Street Light standards; Open Space types; and for consistency with the updates to the Ordinance Text. |
2. | Exhibit E: Proposed Bike & Pedestrian Paths Plan The 4-7-08 Ordinance had an Exhibit E dated 12-6-07 with a different design for the Paths along Morehall Road, White Horse Road, Phoenixville Pike, and Warner Lane. This new Exhibit E is in sync with the new Exhibit D and with the Spring Oak TND and Tyler Griffin TND plan submissions. |
3. | Exhibit G: Summary of TND District Regulations This single-page table summarizes the Use Regulations, and Area and Bulk Regulations, for all of the TND districts. |
4. | Exhibit H: TND-1 and TND-5 District Street and Alley Design Standards This single-page table displays TND-1 and TND-5 Design Standards with respect to critical dimensions within the right-of-way: Streets, Alleys, On-Street Parking, Street Edge Strips, and Sidewalks. |
5. | Definitions Nine (9) new terms are defined: four (4) are applicable to all TNDs, and include: Active Recreation Facilities, Common TND Open Space, Natural Resource Conservation Areas, and Passive Open Space Areas. Five (5) new terms relate only to TND-5, including: Condominium, Footprint, Lot Area Equivalent, Residential Use Area, and Retail Use Area. |
6. | Street Lights Additional Street Light standards have been added to the Text and to Exhibit B with respect to maximum pole height, cutoff, glare shielding, fixture type (LED), and Township oversight. A reference has been added requiring compliance with the lighting provisions of Section 1619 of the Zoning Ordinance, for all items not specified in the TND Ordinance. |
7. | Limited Allowances for Modified Lot Geometry Provisions were added to the overall Design Standards to appropriately permit modified Street Wall and Build-To Line dimensions for corner lots and lots located along street curves. Within the TND-1 requirements, provisions were added to permit modified Lot Size and Lot Width dimensions for lots located along street curves. Within the TND-1 and TND-5 requirements, provisions were added to permit modified Lot Width dimensions for corner lots. |
8. | Accommodation of TND-5 Condominium Organization While the fundamentals of the TND-5 requirements remain intact, the Ordinance Text required updates to Definitions and Area and Bulk Regulations in order to be consistent with the Condominium arrangement proposed for TND-5. These updates pertain specifically to: calculating compliance with the maximum impervious coverage requirements; and defining a Lot Area Equivalent with a Condominium Footprint, as an alternative to a typical fee-simple Lot Area. |
9. | TND-5 Tract Perimeter Setback The TND-5 Tract Perimeter Setback requirement was modified to reduce from 100 feet to 75 feet the setback for residential uses abutting lands zoned residential or institutional. |
10. | Modifications Process Language was developed an inserted into the Ordinance text that describes the process by which the Township may approve design Modifications. |
