Mr. Rogers made an announcement that the DP Whitehorse I, LLC Sketch Plan was not going to be reviewed this evening. The applicant had something come up and requested to be moved to a future meeting.
Dennis Parison, 33 Aldham Road, questioned whether there had been any updates regarding the Devault Rail Trail. He further stated that the trail would go right in front of his house and he would want updates regarding the trail. Mr. Heleniak stated that there has not been much progress on the trail. TMACC is working with the Open Space Institute to try to appraise the rail bed properties to be able to start negotiations with Norfolk Southern but hasn’t heard anything lately. He stated there is a meeting scheduled for the end of the month to get an update, however nothing is going to happen anytime soon. Mr. Churchill further stated that the property is still owned by Norfolk Southern, so we first have to value the property and then negotiate with them on a sale price. Then we would have to raise the funds to actually purchase the property.
Mr. Richter moved to approve the March 11, 2025 meeting minutes and Mr. Walker seconded. Mr. Rogers called for discussion and there being none called the vote. All were in favor.
Mr. Jason Owens was present to discuss the waiver request for an accessory structure in a front yard. He gave a brief overview of the history of the project and the confusion surrounding the requirement to seek a waiver. Mr. Heleniak added that Mr. Wright’s office did include it in his review letter and the applicant acknowledged it, but that the waiver was not sought and the permit was issued. The applicant seeks approval of a waiver to complete construction an accessory structure in the front yard. Tyler Freed, P.E., of Mease Engineering displayed a site plan showing the location of the structure and shared the purpose of it is for package deliveries and trash can storage. He stated the structure is approximately 12’ x 12’ and it was approved by the French and Pickering Creeks Conservation Trust.
Vince Marucci of Entrophy Consulting distributed architectural plans showing the accessory structure and what it will look like once completed. It was designed with a farmhouse aesthetic to match the architecture of the area structures.
Mr. Churchill moved to recommend approval of the waiver request and Mr. Westhafer seconded. Mr. Rogers called for discussion and there being none called the vote. All were in favor.

There being no further business, Mr. Walker adjourned the meeting at 7:12 p.m. The next meeting will be held on June 10, 2025, at 7:00 p.m. at the Township Building, 11 General Warren Blvd, Malvern, PA.
